You are solely responsible for your use of content in combination with any other images, graphics, text, or other materials you incorporate into your products. You agree that you will not include any text, image, design, trademark, service mark, or any copyrighted work of any third party in your products unless you have obtained the appropriate authorizations from the owners.

You warrant that your products do not infringe upon any rights of any third party, including copyright, trademark, right of publicity or privacy, and will not libel or defame any third party. By placing an order on this Site, you warrant that you have all necessary permission, right, and authority to place the order and you authorize PackEnza to produce the products on your behalf.

Customer Content & Conduct
Section 03

All information, data, text, photographs, graphics, messages, and any other materials ("Content") are the sole responsibility of the person who produced such content. You are responsible for all content that you send, upload, post, or otherwise transmit via the website.

You agree to comply with all local rules regarding online conduct and acceptable content. You agree not to use the website to upload, post, or otherwise transmit any content that:

  • Is unlawful, threatening, abusive, defamatory, or obscene
  • Invades another person's privacy
  • Infringes the intellectual property rights or other proprietary rights of PackEnza or any third party
  • Contains software viruses, malware, or other harmful code
  • Would further the commission or concealment of any crime

You are responsible for protecting your password and controlling access to your registered account. You will be responsible for all orders placed or other actions taken through your registered account.

When you, or someone to whom you have given access, places an order using your password, you grant PackEnza the worldwide, royalty-free, non-exclusive license to use, reproduce, sublicense, modify, adapt, publish, display, and create derivative works from the content on the website and on the printed product for the purposes of storing designs or processing print orders.

Customer Submitted Artwork
Section 04

All artwork, designs, and images must be provided in CMYK format with a minimum resolution of 300 DPI at 1:1 scale.

  • PackEnza is not responsible for any color changes that occur in conversions from RGB to CMYK color modes
  • PackEnza is not responsible for images printed as fuzzy, distorted, or pixelated due to customer-provided artwork that does not meet our specifications
  • Design files provided by PackEnza are at 72 DPI (low resolution). Higher resolution files are available upon request for an additional charge

Important: By approving artwork files, you confirm that you possess the necessary copyrights or permissions for all content included โ€” text, images, illustrations, or any other materials used within the design.

Proofing & Print Matching
Section 05

All print jobs require customer approval of the final artwork and job specification sheet. Once an order has been placed, final artwork proofs and a job specification sheet will be sent to customers via email.

Customers are responsible for reviewing all details mentioned in the specification sheet โ€” including delivery dates and production speed โ€” and confirming that all requirements have been accurately noted. PackEnza is not liable for any specifications beyond what is noted in the final specification sheet.

What is shown on the final proof represents exactly what will be printed. PackEnza strongly recommends printing the proof at 100% to check actual position, spelling, and design elements.

PackEnza will not be responsible for any design or spelling issues not identified by the customer prior to approval. Upon approval, the design file and job specifications will be forwarded to production and printed as-is.

PackEnza is NOT liable for errors caused by:

  • Graphics orientation, placement, or incorrect font usage
  • Spelling, grammatical, and punctuation errors
  • Wrong die cuts, slits, or incorrect and missing folds
  • Finished product size discrepancies approved in proof
  • Color or ink density on screen proofs approved by the customer

PackEnza is not liable for color matching or ink density on screen proofs. Screen proofs predict design layout, text accuracy, image proportion, and placement โ€” but not color or density. Application of lamination may also affect or change the appearance of printed colors.

Materials & Paper Stock
Section 06

Please note that the paper/card stock used for printing our products is not food grade by default. Any food-grade requirements must be communicated in writing before placing your order.

If you have specific food-grade requirements with regards to paper stock, please notify us before the placement of your order. PackEnza cannot be held responsible for any issues arising from failure to communicate such requirements in advance.

For large or bulk orders, minimal differences of up to ยฑ5% in color, quantity, or dimensions may occur due to standard printing trade tolerances. This is industry-standard and not considered a defect.

Color Accuracy & Hardcopy Proofs
Section 07

PackEnza will reproduce color from submitted print-ready files as closely as possible. However, PackEnza cannot guarantee an exact color match or color density due to limitations in printing processes, different properties of various printing surfaces, and neighboring image ink requirements.

  • The accuracy of color reproductions is guaranteed to be within 90% of the final approved proof
  • PackEnza can only guarantee color reproduction if you order a hardcopy proof for an additional charge
  • PackEnza is not responsible for color variations between submitted print-ready images and the actual artwork or product they represent

Digital print samples may have color variance with final production orders due to different print methods and color reproduction processes.

Order Cancellation
Section 08

Once an order has been approved for printing, it is considered a final sale and can no longer be cancelled or refunded. This is because the printing process has already begun and resources have been invested into the production of the order.

It is important to carefully review your design and all details of your order before approving it for printing to ensure it meets your expectations.

Note: Orders cannot be cancelled due to delays in the printing or shipping processes. Once an order has been successfully placed, no refunds are issued for design service orders.

Returns, Refunds & Reprints
Section 09

Due to the custom nature of our printing and packaging products, all sales are final. Since each order is unique to the customer and has no resale value, we do not issue refunds except as described below.

If PackEnza verifies that an error was made on our end โ€” whether in printing or any other aspect โ€” we will acknowledge it and commit to reprinting the defective pieces at no additional cost, or we will offer store credit equal to the cost of the affected pieces.

To Request a Reprint:

  • The customer must notify PackEnza within 3 business days of order delivery of any defects, damage, or missing items
  • Claims filed after 3 business days of the delivery date will not be accepted
  • To receive replacement products, the customer must return at least 99% of the received product within 10 days of the initial delivery date (at the customer's own expense)
  • No returns will be accepted without prior written return authorization from PackEnza
  • All charges related to expedited printing or shipping are non-refundable, including for returned orders

Once the printing process begins, any changes may incur additional costs and delays. Your approval of artwork constitutes your consent for us to proceed with production.

Damaged & Lost Packages
Section 10

Customers are responsible for inspecting all packages for any visible signs of damage or missing items before accepting delivery. In the case of damage or missing items, the customer must notify PackEnza and the delivery courier immediately.

  • PackEnza will not be responsible for any damage or missing item claims not filed within 3 business days of order delivery
  • PackEnza is not responsible for third-party shipping errors, omissions, or damaged shipments
  • Additional shipping and handling charges will apply for packages reshipped due to customer error in submitting the correct shipping address

Each ordered product is usually shipped with a few extra pieces free of charge. Printing trade standards allow for underage or overage of up to 5%. If an exact quantity is required, we recommend ordering 10% over the required amount.

Order Shipping & Delivery
Section 11

An estimated delivery time will be provided once your order is placed. Delivery times are estimates and commence from the day you approve the final specification sheet, not the date of order placement.

  • Unless there are exceptional circumstances, PackEnza endeavors to fulfill orders within the agreed production timeline after proof approval
  • Business days mean Monday to Friday, excluding public holidays
  • Final proof approval must be received by 11:00 AM EST; otherwise one business day will be added to shipping times
  • Products may be delivered in separate shipments

All customers agree not to hold PackEnza liable for delays caused by technical issues, weather conditions, shipping company delays, international customs issues, or any other circumstances beyond PackEnza's direct control.

All customers agree to pay all customs duties and fees for goods shipped to their respective locations. It is the customer's responsibility to arrange clearance for shipments delivered outside the United States.

Rush Orders: In the case of delays in the printing or shipping processes, rush charges or expedite fees will be refunded or waived where applicable.

Indemnity
Section 12

You agree that you shall indemnify and defend PackEnza and all parties from whom PackEnza has licensed portions of content, and their directors, officers, and employees, against all claims, liability, damages, costs, and expenses โ€” including reasonable legal fees โ€” arising out of or related to:

  • Your breach of these Terms and Conditions
  • Any suit, claim, or demand arising from or relating to any text, photograph, image, graphic, or other material you incorporated into products that was not part of the standard Site Content
  • Any unauthorized use of third-party copyrighted material in your submitted artwork

Limitation of Liability
Section 13

In no event shall PackEnza or its licensors, suppliers, or vendors, their officers, directors, employees, or agents be liable for any special, incidental, indirect, or consequential damages of any kind, or for any damages whatsoever resulting from:

  • Loss of use, data, or profits
  • Failure to provide products or services that you order from PackEnza or its affiliates
  • Damages arising from mistake, omission, virus, delay, or interruption of service

In no event shall PackEnza be liable or responsible for any damages or consequences arising from or related to your inappropriate or unauthorized use of this site or its content.

To the maximum extent permitted by applicable law, PackEnza's total liability shall not exceed the amount paid by you for the specific order giving rise to the claim.

PackEnza makes reasonable efforts to ensure that the website is secure, but does not guarantee that materials are free of viruses, worms, Trojan horses, or other destructive code. You are responsible for implementing safeguards to protect your computer system and data.
